Summer wanes, fall's just around the corner. It's a time of bold colours and flavours, and celebrating the bounty of the harvest. Here's a selection of absolutely mouth-watering recipes courtesy of Foodland Ontario that pays homage to the flavours of Mexico while celebrating our local harvest.

Apple Empanadas

These pastries are traditionally filled with a beef mixture, but they do make wonderful little apple pies.

Ingredients:

  • 3 cups (750 ml) all-purpose flour
  • 1/2 tsp (2 ml) salt
  • 1/2 cup (125 ml) lard
  • 2 eggs
  • 3/4 cup (175 ml) milk

Filling:

  • 4 cups (1 L) coarsely diced peeled apples (about 2 lb/1 kg)
  • 1/2 cup (125 ml) granulated sugar
  • 2 Tbsp (30 ml) all-purpose flour
  • 1 tsp (5 ml) cinnamon
  • 1/2 tsp (2 ml) grated nutmeg

Directions:

In large bowl, whisk together flour and salt. With pastry blender, cut in lard until very fine crumbs. Whisk one egg with milk; pour over flour mixture, stirring until it clumps together. Turn out onto floured surface and knead to form soft dough. Wrap and refrigerate for 30 minutes. (Can be refrigerated for up to 2 days.)

Filling: Stir together apples, sugar, flour, cinnamon and nutmeg.

Divide dough into 12 pieces and form into balls. On a lightly floured surface, roll each into 6-inch (15 cm) circle. Spoon about 1/3 cup (75 mL) filling onto half of each circle, mounding slightly. Fold over other half and press to seal. (A floured fork works well.) Arrange on 2 greased baking sheets. Beat remaining egg; lightly brush over tops. Bake in 375F (190C) oven until golden, 25 to 30 minutes.

Makes 12.

Vitualla (Braised Beef with Rice and Fruit)

Instead of browning meat, then braising it, Mexican cooks often do a reverse braising with a bit of water that cooks off to leave the meat dark and caramelized. Here, along with wedges of cabbage, it is served on rice sweetened with saut?ed pieces of pears and peaches. Serve this interesting mixture of flavours and textures with a fairly hot salsa.

Ingredients:

  • 3 lb (1.5 kg) beef short braising ribs
  • 2 onions, quartered
  • 5 cloves garlic, lightly crushed
  • 1 tsp (5 ml) sea salt
  • 1 small cabbage, cut in 6 wedges
  • 2 cups (500 ml) sodium-reduced chicken broth
  • 1 cup (250 ml) long grain rice
  • 2 Tbsp. (30 ml) vegetable oil
  • 3 pears, peeled and coarsely diced
  • 3 peaches, unpeeled and coarsely diced
  • 2 jalape?o peppers, seeded and diced
  • 2 Tbsp. (30 ml) granulated sugar
  • 1 tsp (5 ml) ground cumin

Directions:

In wide deep skillet or saucepan, place ribs, onions, garlic and salt. Barely cover with water and bring to simmer over medium heat; cook, uncovered, until meat is tender and most of the water has evaporated, turning ribs over occasionally, about 2 hours.

Place cabbage wedges on top; cover and simmer until cabbage is tender, about 15 minutes.

Meanwhile, in saucepan bring broth and rice to boil; reduce heat, cover and simmer until rice is tender and no liquid remains, about 20 minutes.

In large skillet, heat oil over medium heat; cook pears, peaches, jalape?o peppers, sugar and cumin, stirring gently, until fruit is tender, about 5 minutes. Gently mix in rice. Serve with the cabbage and meat on top.

Serves 4-6.

(AP) ? Lindsay Lohan got into an argument early Sunday with a 25-year-old man in her New York City hotel room over photos on a cellphone and she was physically grabbed or thrown, a law enforcement official said.

The official was not authorized to speak publicly about the encounter Sunday morning and spoke to The Associated Press on condition of anonymity.

Christian LaBella of Valley Village, Calif., was taken into custody around 6 a.m., authorities confirmed. He faces a misdemeanor assault charge and a harassment charge. He was still in custody Sunday afternoon and could not be reached for comment.

Police acknowledged that LaBella was arrested but did not identify the other party because that person is the alleged victim of assault.

The official said Lohan and LaBella had encountered each other earlier in the night at a club. It was unclear whether they had met before.

Lohan was injured but not hospitalized, her publicist, Steve Honig, said in a statement.

"Lindsay has spoken with police and is fully cooperating with the investigation," he said. He declined to comment further.

Lohan herself has had several run-ins with law enforcement.

Last week, Lohan, 26, was accused clipping a pedestrian with her car outside a nightclub and driving away. She was given a ticket and was scheduled to appear in court Oct. 23. Honig has said he expects those allegations to be proven false.

The actress was also involved in a car accident in California this summer that sent her and an assistant to a hospital, but didn't result in serious injuries for anyone. The accident remains under investigation.

In May, she was cleared of allegations that she struck a Hollywood nightclub manager with her car.

Lohan remains on informal probation for taking a necklace from a jewelry store without permission last year. That means she doesn't have to check in with a judge or probation officer but could face a jail term if arrested again.

Lohan recently filmed "The Canyons," a movie by "Less Than Zero" author Bret Easton Ellis.

Court of Appeals for the Federal Circuit tells Judge Koh to revisit Galaxy Tab 10.1 injunction

One of the hallmarks of the US judicial system is its seemingly inexhaustible system of appeals -- a system for which Samsung is likely most grateful at the moment. Its earlier entreaty to Judge Lucy Koh to have the Galaxy Tab 10.1 preliminary injunction lifted may have been denied, but the Court of Appeals for the Federal Circuit is giving the Korean company another bite at the Apple. That court has granted Samsung's request to have the injunction issue remanded so that the trial court can re-consider Samsung's motion to dissolve it. The ruling enables Samsung to argue that the injunction should be lifted because the jury failed to find infringement of the tablet design patent upon which the injunction is based. Will Judge Koh lift the ban? Perhaps, but we're pretty sure that the crowd from Cupertino will be doing plenty to prevent that from happening. Stay tuned.

Air management includes all the minute details of design that are required to minimize or curtail the mixing of cool air supplied to the room with the hot air rejected from the room. When it is designed correctly, it helps in reducing the operating and maintenance costs of the equipment and other issues caused by the thermal heating of the devices.

The main design issues related to air management are:

  • Location of the data center
  • Location of the cooling equipments
  • Equipments required for intake and exhaust ports
  • Configuration
  • Air flow patterns in the room

Principles of air flow management:

  • Use of hot and cold-aisle configurations can double-up the cooling efficiency of the data center.
  • With the aide of an airside economizer, air management can reduce data center cooling costs by over 60%
  • Removing hot air immediately through the exhaust improves efficiency rather than mixing the hot air with the incoming cold air.
  • Equipment environmental temperature specifications refer primarily to the air being drawn in to cool the system.
  • A higher difference between the return air and supply air temperatures increases the maximum load density possible in the space and can help reduce the size of the cooling equipment required, particularly when lower-cost mass produced package air handling ?units are used.
  • Poor airflow management will reduce both the efficiency and capacity of computer room cooling equipment.

?Therefore an effective air flow management system can bring down the costs and power consumption rates to a great extent. Design of these systems also play a very important role in the quality, reliability, and security of data centers.

Goldman sees China's growth slowing to 7 percent for next decade

SINGAPORE (Reuters) - China's economy is expected to grow at a much slower pace of about seven percent over the next decade, but its stock market still has the most attractive upside among "BRIC" countries, according to Jim O'Neill, Chairman of Goldman Sachs Asset Management.

"China is in the early stages of going from a long period where it was all about the quantity of growth, into an era where the focus is on the quality of growth," O'Neill told a news conference in Singapore.

O'Neill, who coined the term "BRICs" to describe the emerging countries of Brazil, Russia, India and China, said markets have not fully factored in the next decade of slower growth for the world's second-largest economy.

That, he said, explains the underperformance of China's stock market.

After three decades of breakneck development that saw annual growth average of 10 percent, China's government is trying to steer growth lower to complete structural economic reforms.

"We're all used to the drug of 10 percent growth and those days are behind us," said O'Neill.

As China makes its transition, O'Neill expects consumer-related and healthcare companies to benefit, while those that depend on heavy industry production and heavy industry commodities were likely to lose out.

Investors are concerned over the timing of China's planned slowdown, as it could be derailed by the global economic downturn that has sapped overseas orders for exports from China's vast factory sector.

China's CSI300 Index <.csi300> has fallen 2.2 percent so far this year, While the MSCI Asia Pacific ex-Japan's <.miapj0000pus> 12.5 percent rise in the same period.

O'Neill said he expected China's A-shares to rise again over the next year, and disagreed with the what he described as a growing consensus that Chinese equities would never rally again.

However, he saw China's economy continuing to struggle in the near term, and said the slowdown in growth may have spread into the July-September period, which would mark a seventh consecutive quarter of slowing growth.

"It's too soon to say a clear recovery is on the way. The Chinese economy still seems to be softening and it's possible that the economy may be weaker in Q3 than it was in Q2," O'Neill said.

"There are not many signs yet of a big easing in financial conditions, which usually is a good leading indicator of momentum."

China is not alone in facing slower growth. Goldman Sachs Asset Management expects all "BRIC" countries, except Brazil, to see lower growth than they did in the last 10 years.

However, their collective share of the world economy will still rise, and O'Neill noted that recent policy reforms that some countries like India and Brazil have introduced are a good sign.

India introduced sweeping reforms two weeks ago, such as raising the price of heavily-subsidized diesel, aimed at shoring up government finances and attracting foreign investment to revive economic growth.

New clues about ancient water cycles shed light on U.S. deserts

ScienceDaily (Sep. 27, 2012) ? The deserts of Utah and Nevada have not always been dry. Between 14,000 and 20,000 years ago, when large ice caps covered Canada during the last glacial cooling, valleys throughout the desert southwest filled with water to become large lakes, scientists have long surmised. At their maximum size, the desert lakes covered about a quarter of both Nevada and Utah. Now a team led by a Texas A&M University researcher has found a new water cycle connection between the U.S. southwest and the tropics, and understanding the processes that have brought precipitation to the western U.S. will help scientists better understand how the water cycle might be perturbed in the future.

Mitch Lyle, professor of oceanography, led the study with colleagues from Columbia University, University of California-Santa Cruz, Stanford University, Hokkaido University of Japan, Brown University and the U.S. Geological Survey. Their work, funded by the National Science Foundation, is published in the current issue of Science magazine.

The dry shorelines of these glacial lakes were first discovered by 19th century geologists when the west was first explored, Lyle explains, adding that the source of the additional water has been a mystery. By assembling data from ocean sediments and from dry western valleys collected over the last 30 years, Lyle and the team found a new water cycle connection between the southwest U.S. and the tropics.

"Large ice caps profoundly altered where storms went during glacial periods. Before this study, it was assumed that Pacific winter storms that now track into Washington and Canada were pushed south into central and southern California," Lyle notes.

"However, by comparing timing between wet intervals on the coast, where these storms would first strike, with growth of the inland lakes, we found that they didn't match."

The team was able to time wet periods along the California coast from pollen buried in marine sediments from cores archived by scientists at the Integrated Ocean Drilling Program at Texas A&M. They evaluated lake level studies from southeast Oregon, Nevada, Utah, eastern California, New Mexico, and west Texas to find when lakes filled in different parts of the west.

"Many teams of scientists have been working on this problem since the 1950s, when radiocarbon dating first allowed ages to be put on old shorelines," Lyle adds. "The data we synthesized covers a wide latitude so that we could determine how the glacial wet intervals operated."

Only southern California coastal wet intervals matched with the progression of high lakes inland, pointing to the development of a tropical connection, where storms cycled into the region from the tropical Pacific, west of southern Mexico.

"We think that the extra precipitation may have come in summer, enhancing the now weak summer monsoon in the desert southwest. But we need more information about what season the storms arrived to strengthen this speculation," Lyle says.

Not only is the development of the glacial lakes important from a paleoclimate perspective, but it is likely that the lakes were important to the migration of people into North America, Lyle believes. Many of the archaeological sites where early Indians settled when they first came into the U.S. are rock shelters at the edges of these ancient lakes. The lakes were a major source of fish, and a gathering place for deer and wildfowl at that time.

"What we need to do now is look at all of this on a finer scale," Lyle points out. "We need to understand better the processes that directed the storms thousands of years ago, and to predict better what changes might occur in the future."

(AP) ? The cheers began Tuesday morning to celebrate American players simply walking over a bridge to the first tee at Medinah.

Imagine what it will sound like when they make a putt.

The first official day of practice at the Ryder Cup served up a reminder that while Europe has only one rookie on its team ? Nicolas Colsaerts of Belgium ? it has plenty of others who only know what it's like to play before the home crowd.

"We talked a lot about it and there's no doubt, playing at home is a big advantage," Peter Hanson of Sweden said. "We saw it last time in Wales, and we have seen it over here in the past. So I think it's just something we have to deal with, and we have to be stronger this time than we were the last time when we won by one point. So if we are going to get that cup back overseas, we know we have to perform very well."

Home advantage is said to be worth one point, the very margin that decided the Ryder Cup at Celtic Manor the last time out.

Hanson joins Rory McIlroy, Martin Kaymer and Francesco Molinari as Europeans who played their first Ryder Cup before a home crowd. Perhaps they can get some advice from Graeme McDowell, who made his debut in Kentucky four years ago.

"There's no doubt, there's a world of different between playing in front of your home fans and playing in front of the U.S. fans," said McDowell, who lost his opening match at Valhalla with Padraig Harrington. Cutting through the genomic thicket in search of disease variants

ScienceDaily (Sep. 24, 2012) ? In the early stages of that vast undertaking known as the Human Genome Project, enthusiasm ran high. The enterprise would be costly and laborious but the clinical rewards, unprecedented. Once the complete blueprint of life was unlocked, the genetic underpinnings for a broad range of human maladies would be laid bare, allowing custom-tailored diagnosis and treatment and revolutionizing the field of medicine.

Or so it was thought.

Instead, "scientists were confronted with thousands of mutations in the collection of proteins in personal genomes, with no ready guide about what they meant in terms of health or disease," according to Sudhir Kumar, a researcher who directs the Center for Evolutionary Medicine and Informatics at Arizona State Unive rsity's Biodesign Institute.

Kumar explains that scientists and clinicians have turned to computer tools that sift meaningful variants from the glut of mutations they face. But the accuracy of these tools may be low, says Kumar.

Now Kumar, Li Liu and their colleagues describe a new technique that can reduce the rate of false positives in such tests, thereby increasing their reliability. The group's results recently appeared in the advanced online issue of the journal Nature Methods.

The new technique, labeled EvoD (for Evolutionary Diagnosis) capitalizes in part on comparative genomics -- an examination of DNA positions across evolutionary time and between diverse species -- to analyze the likely significance of particular human gene variants. EvoD was shown to work much better for positions that are the most evolutionarily conserved in the protein-coding portion of the human genome -- known as the exome.

As co-author Liu explains, researchers have taken a keen interest in mutations occurring at ultra-conserved sites in the exome, as these are usually the most critical in terms of protein function. Variants that are functionally damaging at such locations -- where evolution is highly resistant to change -- are likely to have profound effects on health, often producing so-called Mendelian diseases, which negatively impact health. EvoD performs better than existing methods in diagnosing these mutations.

The Center for Evolutionary Medicine and Informatics now provides EvoD as an online tool and genomic researchers have begun to use it already. The new technique and the tool pave the way for a deeper understanding of genomic variance and advances the quest for personalized disease diagnoses.

?We are working hard to get an iPhone 5 into the hands of every customer who wants one as quickly as possible," Apple CEO?Tim Cook said?in a press release from the Cupertino-based company. "While we have sold out of our initial supply, stores continue to receive iPhone 5 shipments regularly and customers can continue to order online and receive an estimated delivery date. We appreciate everyone?s patience and are working hard to build enough iPhone 5s for everyone."

Folks who try to order an iPhone 5 at this point will find that the device won't ship for three to four weeks, but based on calls to a random selection of Apple's own stores as well as several carriers' retail locations, there still appears to be a small amount of stock in the brick-and-mortar shops. (And as Cook said, stores are regularly receiving additional?shipments of devices.)

Army general: Pacific refocus means more exercises

FORT SHAFTER, Hawaii (AP) ? The leader of U.S. Army forces in Asia and the Pacific says his soldiers will be able to conduct more exercises with other nations in the region, as the U.S. withdraw from Afghanistan and the military refocuses its attention.

Lt. Gen. Francis J. Wiercinski, the commander of U.S. Army Pacific, said he'd like U.S. soldiers to undertake more exercises with counterparts from nations such as Indonesia, Malaysia and India.

The Army will also be able to have more active duty soldiers, instead of reserves, participate in exercises with allies such as Japan.

"We've been engaged, obviously, in the conflicts in Iraq and Afghanistan, and that's where we've had to focus ? for all the right reasons," Wiercinski told The Associated Press in an interview at his headquarters in Hawaii. "But now that we're having this opportunity, we can get back into the Pacific with our partners here."

The Army has 70,000 soldiers and 12,000 civilians at installations in the Asia-Pacific region.

U.S. military leaders and diplomats have increasingly emphasized the importance of Asia and the Pacific as the region's economies grow and gain clout.

Defense Secretary Leon Panetta stressed last week that the U.S. pivot to the Pacific isn't aimed at containing or threatening China, which now has the world's second-largest economy after the U.S. But Washington has criticized China for lacking transparency while it has rapidly modernized its military and boosted military spending.

The Pentagon in January issued a new national defense strategy declaring that the U.S. would "rebalance" toward the region, noting U.S. economic and security interests are inextricably linked to developments in the area.

Examples of the strategy are slowly emerging.

Last year, the U.S. and Australia announced an agreement for up to 2,500 U.S. Marines to rotate through a joint military training hub in the northern Australia city of Darwin. The Navy next year plans to begin deploying a littoral combat ship ? a new type of vessel that can operate closer to shore than other ships ? to Singapore.

The Air Force, meanwhile, plans to make greater use of airfields and bombing ranges in the Australian Outback.

Wiercinski said the Army doesn't want to set up new bases. Instead, he spoke of soldiers training with other nations to get a feel for cultures, terrain and interaction with U.S. allies.

"We're not talking about putting bases in other countries or a permanent presence anywhere," he said. "We're talking about rotating ? 30, 40 days at a pop."

Wiercinski pointed to the current deployment of a few dozen soldiers to Tonga for a disaster relief exercise as the type of drill likely to become more prevalent.

In the drill, which also involves Australia, France and New Zealand, Tonga calls the U.S. for help after being hit by a major earthquake and tsunami. The Army sends soldiers to the Pacific island nation within 24 hours to assess the situation and report what help Tonga needs.

"Just that, the ability to do that, demonstrates our capability, shows the Tongan government and all the neighbors in the area that we're backing up what we say we can do," Wiercinski said.

Apple, Samsung demand changes to $1B verdict

SAN FRANCISCO ??Neither side in a bitter patent battle is satisfied with Apple's $1 billion jury verdict over Samsung after a three-week trial this summer.

Samsung wants a new trial. Apple is seeking an additional $707 million in damages and interest.

The two companies filed a blizzard of legal papers late Friday and early Saturday with their demands that a federal judge in San Jose significantly amend ? or toss out altogether ? the jury's Aug. 24 verdict.

The jury found that 26 Samsung products ripped off Apple's technology at the heart of its iPhones and iPads.

"Samsung made a calculated business decision to copy the industrial designs, graphical user interfaces, and touchscreen navigation technology of the iPhone and iPad," Apple lawyers wrote in court papers, arguing for the additional damages. "Samsung has reaped extraordinary rewards from its wrongful sale of iPhone and iPad clones by taking market share, revenues, and profits from Apple."

The Apple lawyers contend that the "massive damage to the iPhone's distinctive product identity caused by Samsung's sale of millions of iPhone clones is irreversible."

U.S. District Judge Lucy Koh has scheduled a Dec. 6 hearing to discuss the myriad issues raised by both companies. Samsung says it will appeal if Koh turns down its demands.

The two companies are locked in a ferocious struggle for supremacy in the global smartphone market. Samsung is the worldwide leaders in smartphone sales, securing a market share of 33 percent in the second quarter, up from 17 percent a year ago. Apple's fell slightly to 17 percent, from 19 percent a year ago.

Apple accuses Samsung of essentially selling knockoffs of the Cupertino-based company's iPhones. Apple filed a lawsuit in San Jose federal court, alleging patent infringement. It was the latest legal action between the two companies, who are battling in courts in 10 countries over smartphone technology.

On Friday, Samsung asked the San Jose judge for a new trial. The company's lawyer argued that the jury's verdict was unreasonable and unsupported by the testimony and evidence. The company's lawyers also complained that the judge's strict constraints on the number of witnesses and testimony time deprived it of a fair trial.

"The Court's constraints on trial time, witnesses and exhibits were unprecedented for a patent case of this complexity and magnitude, and prevented Samsung from presenting a full and fair case in response to Apple's many claims," the company's lawyer wrote in court documents.

Representatives of both companies couldn't be reached for comment.?

In this article, we?ll explore how you can shift your thoughts, feelings, and behaviors to realize greater health and happiness.

In his groundbreaking book, ?The Genie in Your Genes,? (Elite Books, 2007) Dawson Church, Ph.D. shares a wealth of research to substantiate how your consciousness shapes your health and happiness. He tells the story of one experiment reported at the American Psychosomatic Society in which 42 couples were given small suction wounds on their skin. They were then instructed to discuss a neutral topic. Their wounds were monitored for healing time.

Two months later, the same couples were given similar wounds and then asked to discuss an issue upon which they strongly disagreed. Their healing times were again monitored. Results of this study showed that the couples wound healing time directly correlated with the hostility levels in their discussions. The most hostile discussions resulted in 40 percent longer healing times than when those same couples engaged in neutral discussions.

The point of this study is not that you should ?avoid conflict,? but that your emotions powerfully affect your physical health and ability to heal. The thoughts, feelings, and behaviors that you consistently engage in affect your biochemistry which in turn affects your health and well-being. This is true all the way down to the DNA level!

The interior environment of your cells is shaped by how you think, feel, and act. These self-initiated, ?consciousness? factors have a great impact on how your genes ?express?-which potentials are turned on and activated and which potentials are turned off and de-activated. In other words, your life is not determined by your genes, but by which genes are activated and which ones are de-activated by your thoughts, feelings, and behaviors, as well as by external environmental conditions. Your health and happiness are not ruled by your DNA.

What does this mean for your life? Could you monitor and manage how you think, feel, and behave to experience better health and greater happiness? Wouldn?t that be awesome?

In contrast, many of us live as if we are the slaves of our thoughts, emotions, and behaviors rather than their master. We live as if mental-emotional-behavioral events control us rather than us controlling them. However, if your thoughts, feelings, and actions have such power when they are allowed to randomly roam freely, imagine how powerful they could be if you consciously cultivated your skill in using them!

What if you conducted an experiment in which you sought to demonstrate how positive thoughts, feelings, and behaviors made a significant positive impact on your own health and well-being? This could be as simple as taking some time every day to focus on experiencing positive thoughts, feelings, and physical sensations. For example, you could make it a practice to begin your day with a short period of time in a positive state of appreciation, gratitude, and trust. This would get your day started on the right foot and set in motion a cascade of positive cellular reactions that support your being healthy and happy. Doing your practice first thing every morning would create a positive reference point that you could return to whenever you got caught up in stress, frustration, or negative thoughts and feelings.

Now, certainly, old patterns of negative thinking, feeling, and acting may seem strong, but they are just habits you?ve learned. What if you could re-program yourself, little by little, in just a few minutes every day? What if you could grow a new positive consciousness so strong, that you?d immediately recognize when you?ve wandered away from it, be able to put a mental pause in your old response, and insert your new outlook at will, at any time. It?s not so far-fetched as it may sound.

Home sellers and real estate agents who are concerned about the upcoming expiry of the federal Mortgage Debt Relief Forgiveness Act still have options for avoiding a tax bill from the IRS, according to Seattle Small Sales, Inc.

With the principal amnesty program set to expire on Dec. 31, 2012, the Bellevue, Wash., team of legal, tax and real estate professionals is assuaging fears that sellers will miss a valuable tax break if their small sales do not close by year end.

This looming deadline is instigating a surge of small sales, clarifies Ross Kilburn, who notes that small sales increased 25 percent nationwide in the first quarter of 2012 over the previous year. What most homeowners and many brokers do not realize is that the IRS offers several non-expiring exemptions that allow sellers to circumvent the income tax assessed on forgiven debt.

An estimated 11 million Americans are underwater on their mortgages, carrying nearly $ 700 billion in negative equity as they try to ride out the recession. With one in every five homes worth less than is owed, the U.S. government passed the Mortgage Debt Relief Forgiveness Act in 2007, and then renewed it in 2009, to help homeowners recover from the economic crisis.

Prior to the Mortgage Debt Relief Forgiveness Act, the IRS taxed most forgiven debt as income. Under the current laws, the Act temporarily suspends this penalty when a lender absolves a customers mortgage debt. In order to qualify for the federal relief program, underwater mortgage holders must demonstrate extreme financial hardship, whether from a layoff, retirement or unexpected medical costs. Up to $ 2 million of debt can be forgiven by lenders.

Although the Mortgage Debt Relief Forgiveness Act expires at the end of this year, many underwater homeowners who small sale their homes will still be able to use the insolvency clause to avoid paying income taxes. In order to avoid paying taxes on discharged debt under the insolvency clause, the total amount owed to all creditors must be greater than the honest market value of all the homeowners assets. Liabilities, such as mortgage debt, credit card debt, student loans and vehicle loans, are balanced against assets like the home, vehicles, jewelry, artwork, bank account balances and retirement savings.

If a borrower is insolvent, the discharged debt is not taxable, up to the amount of the insolvency. For example, if a seller has a combined debt of $ 400,000 and assets totaling $ 145,000, then up to $ 255,000 of debt can be forgiven without being taxed. Since any absolved principal above this amount brings the seller back to financial solvency, the balance beyond $ 255,000 is taxable.
