Fed dissenter: Latest policy move could backfire

(AP) ? Charles Plosser, president of the Federal Reserve Bank of Philadelphia, says he voted against the Fed's latest attempts to boost the economy because he fears they could backfire and unleash inflation.

The Fed's policy committee voted 7-3 last week to try to lower long-term interest rates by reshuffling its investment holdings. The Fed will shift $400 billion from short- to long-term Treasurys.

Plosser becomes the second of the three dissenters to explain his no vote. On Tuesday, Dallas Fed President Richard Fisher said he feared the Fed's action would fail and hurt banks.

In remarks prepared for a speech Thursday outside Philadelphia, Plosser says the Fed's attempts to lower rates are unlikely to work and could escalate inflation, potentially leading to "stagflation" ? high prices, low growth and high unemployment.

Suspicions about renegade legal group

Legal experts yesterday suspected the ulterior motives behind a proposal by a small group of legal scholars who are seeking invalidation of judicial decisions resulting from the military coup of 2006.

They expressed their suspicions that the move by the group, which calls itself Nitirat (Citizens of Law), appeared to be benefiting certain politicians rather than the country as a whole, contrary to the claim of the group.

The Lawyers Council of Thailand yesterday issued a statement that the Nitirat group's proposal would annul the negative impacts on those corrupt politicians, which would only benefit the politicians rather than society as a whole.

The council called on members of the public to closely monitor the group's next moves.

"The Lawyers Council of Thailand disagrees with the Nitirat group's proposal, which could lead to social division," said Sak Korsaengruang, chairman of the lawyers' council. He noted that Nitirat consisted of only seven people and that many of their fellow law experts at Thammasat University disagreed with their move.

In the council's view, Nitirat's proposal seeking annulment of judicial decisions resulting from the coup would be selective, benefiting certain groups of people favoured by the legal scholars, instead of being applied universally, according to Sak.

He said the council was against overthrowing a legitimate government as it was against the democratic principle. However, he added, the council also disagreed with an elected government that abuses its power by dominating Parliament and influencing the mass media and independent organisations.

Sak said the coup resulted in many beneficial court decisions and laws, adding the current government and Parliament also came into existence as a result of the coup.

In a related development, Thammasat University rector Somkit Lertpaithoon posed 15 questions in his Facebook account to Nitirat regarding its controversial proposal.

He asked whether the asset-concealment case against fugitive former premier Thaksin Shinawatra, in which he was acquitted by the Constitution Court with a slim majority, could be retried, as many people were convinced the verdict was wrong. Another question was, "When the Constitution Court ruled in favour of Thaksin, it was fine but when the court ruled against him, it was wrong, wasn't it?"

The rector also asked whether Nitirat considered anything, including the Constitution, that stems from the coup bad, except for the current government.

"Is it true that by implementing Nitirat's proposal, Thaksin will be spared all the legal impacts?" read Somkit's question No 7.

Meanwhile, Army chief General Prayuth Chan-ocha yesterday voiced his opposition to Nitirat's proposal that the Penal Code's Article 112 regarding lese majeste be amended.

"I see no need to amend Article 112 regarding the monarchy. The institution has never harmed anybody but has rather contributed to the country," he said.

The Army chief also called on members of the public to closely follow the matter to determine Nitirat's real intention behind their move.

Dr. Cass: Anxiety is a physical feeling. When you think of anxiety, you might think of it as mental. But you have sweaty palms and a rapid heart rate, and your thoughts are going really fast. That?s the sympathetic nervous system response, called the ?fight-or-flight? response. A protective mechanism, it?s built into all animals, us included, allowing us to escape from predators in the jungle or, in our present life, jump away if a car is coming at us. However, when that stress response ends up being constant, we feel anxious and irritable. It can affect our body?s in many negative ways, from our immune system, to our hormones, and even our bones, causing osteoporosis.

The important thing to learn is how to move from the sympathetic or stress-response of our nervous system to the parasympathetic, or the relaxation response. The good news is, we can do that by simply breathing deeply.aking some deep breaths into your belly releases the diaphragm and releases the tension. Believe it or not, it?s impossible to have that sympathetic nervous response, or that anxiety or stress response, when you?re doing deep breathing.?Try it some time when stopping at a red light, or waiting in line.

Second, watch what you are eating. Very often, we go into this ?fight-or-flight? response when our blood sugar has dipped. You think, ?I?ll just eat some more sugar? which will help, but it?s temporary. Usually, when the blood sugar dips, it?s because you have been eating sugar?pastry or even, coffee which has a similar effect. They stimulate you for a while, since the go right to?your brain ? and the brain runs on sugar, or glucose. You get a sugar hit. You?re happy, you?re energetic, and then you crash. Does that sound familiar?

Consumer group wants Michigan's insurance waiver denied ...

Michigan Consumers for Healthcare, a coalition of 80 nonprofit advocacy and provider groups, is asking Medicare to deny Michigan?s request to delay a federal regulation that would require health insurers to pay 80 percent of premiums to providers.

The health care coalition says the state?s waiver application to the U.S. Department of Health and Human Services would cost consumers $53 million, or $164 per person.

?The current administration has essentially decided that the commercial insurance industry needs the consumer?s hard-earned money more than the consumer does,? said Don Hazaert, the coalition?s director.

Michigan Consumers includes the Area Agencies on Aging of Michigan, the Greater Detroit Area Health Council, the Detroit Wayne County Health Authority and the American Heart Association.

In July, Michigan Insurance Commissioner R. Kevin Clinton asked the federal government for a three-year phase-in of a requirement that health insurers pay providers 80 percent of premiums this year or reimburse individual policyholders the difference in 2012.

Under the 80 percent ?medical loss ratio? requirement ? that only applies to the individual insurance market ? Clinton said 14 health insurers would be required to issue rebates totaling $30.6 million.

Those 14 insurers include eight that would pay rebates in excess of their after-tax profits for 2010, Clinton said.

Under the Patient Protection and Affordable Care Act of 2010, states are allowed to ask the HHS secretary to adjust the medical loss ratio if ?the standard may destabilize the individual market? and ?could result in fewer choices for consumers.?

Based on a federal analysis, HHS said 9 million insured people could be eligible for rebates worth up to $1.4 billion starting in 2012.

The reform law also requires health insurers to publicly report their medical loss ratios. The Michigan Office of Financial and Insurance Regulation has a list of health insurers? medical loss ratios.

Michigan only requires health insurers to pay 65 percent of premiums to providers for policies rated by age and 55 percent for other policies. Some plans, including Blue Care Network, are already below the 80 percent medical loss ratio.

Libyan NTC forces thrust deep into Gaddafi home town (Reuters)

SIRTE, Libya (Reuters) ? Libyan interim government forces backed by NATO warplanes have mounted their deepest thrust into Muammar Gaddafi's home town of Sirte, getting as close as half a kilometer from the center of the deposed leader's coastal stronghold.

Gunfire could be heard coming from the town center and black smoke rose as National Transitional Council (NTC) forces massed in Zafran Square on Saturday and moved up tanks and mortars. Pick-up trucks mounted with machineguns and loaded with fighters raced in.

Field medics said two NTC soldiers had been killed and more than 20 wounded in the fighting against pro-Gaddafi forces.

"They have snipers above the mosques, above the buildings. They're using the houses and public buildings," NTC fighter El-Tohamy Abuzein told Reuters from his position in Zafran Square.

The NTC assault plan has divided Sirte into three zones. "They took area number one and they are fighting in area number two and they are holding there until morning," NTC commander Fathi Bafhaaga told Reuters.

Reuters journalists at the scene said it was the deepest NTC fighters had got into Sirte, but it was not possible to verify whether the NTC was holding onto its gains overnight.

Taking Sirte would be a huge boost for the NTC as it tries to establish credibility as a government, and a devastating blow for Gaddafi, widely believed to be on the run inside Libya.

NATO, whose warplanes played a vital role in the six-month war that toppled Gaddafi, said its planes had hit a number of targets in Sirte in the previous 24 hours, including an ammunition depot and an anti-aircraft gun.

It said in a statement the air attacks had been mounted to protect civilians from Gaddafi forces inside the town.

"Among the reports emerging from Sirte are executions, hostage-taking, and the calculated targeting of individuals, families, and communities within the city," NATO said.

Previously, NTC forces have retreated from Sirte and the other final Gaddafi stronghold, Bani Walid, after poorly organized assaults met fierce resistance from his loyalists.

Though NTC forces have tightened their grip in the past few days on southern oasis towns that sided with Gaddafi, that progress has been overshadowed by unsuccessful efforts to take the last strongholds.

NTC commanders say their advance on Sirte has been hampered by the presence of large numbers of civilians, many of whom have fled in the past week.

A Gaddafi spokesman has accused NATO of killing several hundred civilians in strikes on Sirte. Communications have been largely cut off since the fall of the capital Tripoli last month.

"FORBIDDEN" WEAPONS FOUND

NTC leader Mustafa Abdel Jalil said on Saturday interim government forces had found suspected internationally banned weapons near the towns of Sabha and Wadan, but he gave no details about them.

"There are weapons believed to be internationally forbidden, and they are under our control," he told a news conference at the NTC's headquarters in its eastern Benghazi base.

"We will seek help from local experts and the international community to get rid of these weapons in a suitable way."

The NTC, the political leadership of the rebel movement that rose up against Gaddafi's 42-year-rule and drove him from power with support from the West and several Arab nations, faces a challenge in trying to impose its authority across Libya.

It said last week it would move to Tripoli only after its forces were in full control of Libyan territory, contradicting an earlier pledge to move the interim administration from Benghazi around mid-September.

Raising a new challenge, Abdelraouf al-Kurdi, a representative of fighters from a Tripoli district, said arms seized from sites in the capital had been taken to other parts of Libya by fighters who filled the city to overthrow Gaddafi.

Interim government forces operate in disparate units based on their home towns, with little overall command.

NTC officials have said Gaddafi used mercenaries from sub-Saharan Africa to bolster his ranks during the war.

Tanks were seen moving beyond the gate toward Sirte and Reuters journalists said NTC forces got to within 40 km of the city and were planning to hold that position after nightfall.

"We are coming for you, wild-haired one," fighters chanted, referring to Gaddafi.

On Thursday, the NTC said it had taken full control of Sabha, which was the traditional base for Gaddafi's own tribe. About 800 km (500 miles) south of Tripoli, it had been occupied by fighters loyal to him.

The NTC says it also controls Jufra, to the northeast of Sabha, and the nearby oasis towns of Sokna, Waddan and Houn.

The manhunt for Gaddafi, who has been in hiding for weeks occasionally issuing audio messages through Syrian-based Arrai TV, is drawing closer to its target, NTC officials say.

My husband seperated for the military in 07. This is the first time we are buying a home. We found one we really wanted. And I called the bank to schdule a date to see if we are approved. We have great credit. And she said that that bank only does State VA loans and we should call the county and see which one we qualify for. I don?t know the county number. Where can i find that? Also what is the difference between state and Federal VA loans. And does anyone know the interest percent on VA loans. Someone told me that regular loans are better and save you money in the long run. Is this true? Also I heard that with a VA loan you don?t have to put any money down but you have to pay some sort of Fee. I really want this house and I don?t know how to find all this info. And i want to make sure i am chosing the right type of loan. Any one please help. Any Info on va loans would be awesome. Thanks

A: Here are the steps:

Select a home and discuss the purchase with the seller or selling agent. Sign a purchase contract conditioned on approval of your VA home loan.
Select a lender, present them with your Certificate of Eligibility and complete a loan application.

Ruling clears way for Liberty Media split-off (Reuters)

(Reuters) ? John Malone's Liberty Media Corp overcame a court challenge on Wednesday to its plan to split off Liberty Capital and Liberty Starz tracking stocks.

Delaware's Supreme Court affirmed a lower court ruling that the split-off of assets do not amount to a default under a bond indenture agreement.

The bond trustee had argued that the split, when taken together with three prior asset distributions by Liberty Media, amounted to a strategy to remove Liberty Media's assets out of the corporate structure and transfer them to shareholders.

Because the bonds have their claims against the corporate structure, the trustee argued the distribution might violate the bond indenture and threatened to declare a default.

Delaware's Supreme Court found that the lower court was correct to rule the current asset split is not sufficiently tied to the previous asset splits.

Italy criticizes S&P downgrade as political

(AP) ? Italy criticized Standard & Poor's on Tuesday for downgrading its credit rating, saying the decision seemed politically motivated and out of touch with reality at a time when the government was working to boost growth and reduce its debts.

Late Monday, S&P cut Italy's credit rating by one notch to A from A+ in light of what it sees as the country's weakening economic growth prospects and higher-than-expected levels of government debt.

Markets, which were buoyed by hopes that Greece will not be allowed to default, took the surprise move in stride. But the downgrade is likely to reinforce fears that the eurozone's third largest economy is getting sucked into Europe's debt crisis, which has already seen the bailout of three countries.

Premier Silvio Berlusconi's office said in a statement Tuesday that S&P's evaluation "seems dictated more by behind-the-scenes reports in newspapers than reality and seems contaminated by political considerations."

Though S&P's rating is still five steps above junk status, it is three below that given by rival Moody's, which is currently assessing Italy.

Italy's debt burden of 120 percent of GDP is the second highest in the eurozone after Greece. It has carried heavy debts successfully for years because bond investors have always been willing to loan more money as bonds came due.

But bond markets began to look more skeptically at Italy after Greece, Ireland and Portugal needed bailouts and the government has had to pay more to borrow as a result. That threatens a vicious circle in which rising interest costs threaten to sink government finances and the country finds itself cut off from bond markets. In that case it either needs a bailout loan from another source or must default.

The government insisted it had a solid majority in parliament, which recently passed measures to get a tighter grip on the public finances through a package of tax increases and budget cuts.

It said the government was working on growth measures, had pledged to balance the budget by 2013 and said the fruits of its growth and austerity plans "will be seen in the near-medium term."

S&P warned that it may downgrade Italy again, slapping a negative outlook on its ratings. It anticipates that political differences will likely limit Italy's ability to respond decisively to its debt crisis.

"What we view as the Italian government's tentative policy response to recent market pressures suggests continuing future political uncertainty about the means of addressing Italy's economic challenges," S&P managing director David T. Beers said.

Markets largely brushed off the downgrade as investors hoped for progress in ongoing Greek debt talks.

Milan's stock market was trading 1.2 percent higher while the yield on the country's ten-year bond was up only 0.08 percentage point at 5.61 percent.

Last week, Italy's Parliament gave final approval to the government's austerity measures, a combination of higher taxes, pension reform and spending cuts that the government says will shave more than euro54 billion ($70 billion) off Italy's deficit over three years.

The planned cuts and taxes sparked street protests in Rome similar to those in other European countries trying to come to grips with the economic crisis.

The European Central Bank had demanded stiff austerity measures to calm markets roiled for weeks over doubts about how serious Italy is about dealing with its debts.

Italy is widely-considered as too big to save. The big worry in the markets is that the country will find it increasingly costly to borrow.

"Italy is now struck in a self-fulfilling downward spiral from which it is unlikely to be able to extract itself without external help," said Sony Kapoor, a managing director of Re-Define, an economic think-tank.

"Without full confidence in the credit-worthiness of Italy, it's impossible to have full confidence in the solvency of the European banking system," he added.

Concerns that Italy might be locked out of bond markets was the main reason why the European Central Bank has splashed out billions of euros over the past month buying up Italian government bonds on the open market.

Doing so has helped get Italy's ten-year bond yield down below the 6 percent level, which is considered unsustainable. However, it's started to edge higher again over the past couple of weeks as investors fret about Europe's debt crisis spreading.

The S&P downgrade, however, could lead to higher borrowing costs for Italy because it implies that investors face greater risks when buying Italian debt.

S&P said that weaker economic growth will likely limit the effectiveness of the government's economic plan.

"We believe the reduced pace of Italy's economic activity to date will make the government's revised fiscal targets difficult to achieve," S&P said.

The firm projects that Italy's economy will grow at an annual average of 0.7 percent between this year and 2014, down from an earlier projection of 1.3 percent growth.

Italian officials have reportedly held talks with China's sovereign wealth fund in an effort to persuade Beijing to buy Italy's government bonds or invest in its companies. The nation's financial crunch also has prompted Rome to consider selling stakes in major state-owned companies such as power utility Enel or oil and gas supplier Eni, according to news reports.

The court?s ruling overturned a lower court decision that voided a patent held by Myriad Genetics on BRCA1 and BRCA2, two human genes used in determining the risk that women face with breast and ovarian cancer. Much hinges on the outcome of such patent challenges, given the thousands of genes that have been patented in the United States and elsewhere.

The appeals court accepted that the chemical structure of DNA, once removed from a cell was ?markedly different? from the DNA found in nature, that is within the chromosone. In this way, the court upheld the general rule that what nature renders remains common to us all, while what is humanly produced is subject to patent. It also upheld in this case the limited nature of patents, by ruling against Myriad?s ability to patent its method of analyzing patient risks levels, declaring that Myriad?s filing involved, ?patent-ineligible abstract mental steps.??

The suit against Myriad?s patents was filed by the American Civil Liberties Union and the Public Patent Foundation (acting on behalf of cancer patients, who can face a $3,000 charge for the breast cancer risk test), as well as medical researchers and societies. Let me show how the distinction is both missing and operative in the case of the BRCA1 and BRCA2 gene patents. The ethical issue here, then, is not the DNA?s relation to the body, before and after it is extracted. It has to do with how the patent is used by those who have rights in it.?

In the U.S., along with Myriad Genetics, which is located in Salt Lake City, the other party with rights to these gene patents is the University of Utah Research Foundation. The Foundation seeks ?to promote, conduct, encourage and facilitate research, development and dissemination of knowledge, and the application of knowledge in all fields of learning.? One way of achieving that goal is to direct a portion of the licensing fees paid to the Foundation for such patents to more research. This might well seem justified until one realizes that there is another way of addressing the responsibilities that arise from the creation of intellectual property in the name of learning and the development of knowledge.?

Seven years earlier, Cancer Research UK won its case to extend its UK patent for the BRCA2 gene (based on the work of Mike Stratton funded by Cancer Research UK) to all of Europe. Many researchers applauded and welcomed this extension of patent rights because Cancer Research UK grants royalty-free access to BRCA2 for publicly owned and non-profit labs. This organization used the patent to protect the public?s right to benefit from BRCA2, while retaining an ability to license it to commercial enterprises.

This is sometimes referred to as ?defensive patenting,? protecting an invention from being patented by others. In this case, a publicly funded agency is using the patent defensively ? should we call it ?ethical patenting? or ?public-interest patenting?? ? to keep this invention in the public realm. By a strange twist in this knowledge-based economy, Cancer Research UK allows for both public and commercial use of its patent, thereby breaking the (seemingly anti-capitalist) monopoly that can lead to undue commercial exploitation.?

Public-interest patenting strikes me as recognizing the distinctive intellectual properties of learning. It responsibly honors the public trust involved in the funding of learning and learned inquiry. It is one way to redirect the university patent race, set off in the U.S. by the Bayh-Dole Act of 1980, into a matter of greater public good.

3 NATO service members killed in Afghanistan

(AP) ? NATO says three service members have died in separate attacks in southern Afghanistan.

The alliance says one service member died following an insurgent attack on Saturday while the other two were killed by bombs on Sunday.

NATO statements did not provide further details on the attacks or the nationalities of the killed service members.

The deaths raise the number of international troops killed in September to 24. A total of 429 members of the international military coalition have died so far this year.

Bail bondsman sues over "Dog the Bounty Hunter" (AP)

Iran lawyer for jailed Americans files bail papers (AP)

TEHRAN, Iran ? The defense lawyer for two Americans jailed in Iran moved ahead with bail arrangements on Saturday, as international efforts intensified to seal a freedom-for-bail deal for the two men, convicted of spying.

Attorney Masoud Shafiei told The Associated Press he was in court, "following up the case" of Shane Bauer and Josh Fattal. Shafiei said he hopes Iran's judiciary will clear the way for payment of $1 million in exchange for the Americans' release.

Bauer and Fattal were detained along the Iran-Iraq border in July 2009 with their friend Sarah Shourd. She was released last September with mediation by Oman after $500,000 was paid. They maintain their innocence.

The first word of the bail offer for Bauer and Fattal, who have been in jail more than two years, came earlier this week from Iranian President Mahmoud Ahmadinejad. He said the Americans could be freed in a matter of days. But Iran's powerful judiciary then responded that the bail provisions were still under review.

The mixed signals could reflect the bitter internal political feuds inside Iran between Ahmadinejad and the country's ruling clerics, who control the courts. Ahmadinejad and his allies are accused of trying to challenge the power of Iran's Islamic establishment.

Shafiei said two judges have to sign the bail papers before the Americans could be released.

By noon Saturday, the Iranian lawyer said one judge had already signed while the second one was expected to do so in a matter of hours. Once the two signatures were in place, the bail money can be posted, Shafiei added.

Mediators from Iraq and Oman have asked Iran to release the men on humanitarian grounds.

A plane from the Gulf state is in Tehran to carry the pair out of Iran if a bail-for-freedom deal is reached. Swiss officials also are involved as representatives of U.S. interests in Iran, which has no diplomatic ties with America.

The men, both 29, were sentenced last month to three years each for illegal entry into Iran and five years each for spying for the United States. They have denied the charges and appealed the verdicts ? which opened the way for the possible deal for $500,000 bail each.

The Americans say they may have mistakenly crossed into Iran when they stepped off a dirt road while hiking near a waterfall in the semiautonomous Kurdish region of northern Iraq. They were detained in July 2009.

U.S. Secretary of State Hillary Rodham Clinton said Thursday the United States continues to hope the Americans will be released, adding that Washington has received word through a number of sources that the two will be returned to their families.

The last direct contact family members had with Bauer and Fattal was in May 2010 when their mothers were permitted a short visit in Tehran.

Since her release last year, Shourd has lived in Oakland, California. Bauer, a freelance journalist, grew up in Onamia, Minnesota and Fattal, an environmental activist, is from suburban Philadelphia.

Bauer proposed marriage to Shroud while in prison.
