State Senators Investigating Breakdowns in Regulation of Texas Hospitals
Two of Texas' highest-ranking senators over health care issues are investigating regulatory breakdowns that allowed a chain of hospitals to endanger patients for the last four years.
State Sens. Jane Nelson and Judith Zaffirini pledged Thursday to get to the bottom of why multiple government agencies failed to take serious action to stop threats to patients and to address potential fraud in Dr. Tariq Mahmood's hospitals.
"I'm deeply troubled that the system failed to protect patients," Nelson, chairwoman of the Senate Committee on Health and Human Services, said in a written statement. "We need to find out where the breakdowns occurred, why the process moved so slowly and what can be done to improve coordination among various regulators who should have seen the signs that patients could be in danger."
It wasn't until this year that health regulators and other government agencies began cracking down on care failures, following the deaths of four patients. Authorities charged Mahmood with health care fraud in April, but federal and state criminal investigative agencies didn't follow up with a whistleblower who warned of potential fraud in 2008. Mahmood has denied wrongdoing and pleaded not guilty.
The lawmakers said they will investigate what legislative changes are needed to prevent such breakdowns. They will be requesting information from state agencies and closely examining existing laws overseeing hospitals, among other steps, according to their staffs.
The problems were outlined Sunday in The Dallas Morning News. The story was based in part on inspection records obtained through the federal government. State law makes those same records off-limits to the public.
Top health regulators were unaware that Mahmood, of Cedar Hill, owned multiple hospitals until The News raised questions about them earlier this year. The Texas Department of State Health Services and the U.S. Centers for Medicare & Medicaid Services are not set up to track ownership of hospital chains or to look for patterns of care problems inside them. Nor do they have the latitude to hold hospital owners accountable for problems.
"Patient safety should be our highest priority," said Zaffirini, a Laredo Democrat who sits on the Senate health committee and is a former chairwoman. "The problems identified at Dr. Mahmood's facilities are appalling. We not only need to find out what happened, but also be pro-active in preventing it from happening again."
Both lawmakers have long records of passing legislation designed to protect patients from negligent care and abuse. They have sponsored laws to develop or enhance databases to flag problem caregivers as well as prohibiting the use of dangerous restraint maneuvers on mentally ill patients.
Last month, Gov. Rick Perry signed a bill written by Nelson, R-Flower Mound, requiring residents and other trainees in hospitals to wear ID badges that clearly display their names and levels of experience. The measure, inspired by care failures of residents at Parkland Memorial Hospital, is designed to help patients summon veteran attending physicians to supervise their treatment.
Zaffirini said she will continue to press for changes she's attempted to make in state law to help regulatory agencies share information and identify "patterns of abuse and neglect" in hospitals.
"I particularly look forward to collaborating with all interested legislators, especially Senator Jane Nelson, in investigating the situation," she said.
Relatives of patients who have died as a result of substandard care at Mahmood's hospitals are hoping for strong reforms.
"Hopefully, we'll see a change in how they monitor hospitals," said Lou Ann Sims, whose aunt, Virginia Rose McCallum, died at Renaissance Hospital Terrell last Christmas. State inspectors cited numerous problems with her nursing care.
"Others' loved ones [shouldn't] have to suffer at the hands of those who are in the health care business for all the wrong reasons."
